Mr. Waidson:

Any first year photography student knows to watermark their photos when placing them on the web, especially if they are concerned about copyright. How is anyone supposed to know who took said pictures otherwise? Does this really need to be explained to you?

Firstly, I should not have to “handle” this in the “normal way” or any other way, copyright theft is theft, plain and simple and if you do not seek permission that is your offence whether I am who I say I am or not.

It does not matter where you found my image, copyright automatically resides with the creator of any image unless specifically indicated or released in some way.

“I found it on the internet” is not a defence in law and certainly is not moral justification for stealing any ones work.

If I were you I would review your policy of picture management carefully, “fair use” is a very flimsy excuse and is rarely supported by the courts in such cases

Secondly, my copyright information is contained within the Exif information for all to see and it is not legally incumbent upon me to protect my work though digital watermarking.

Thirdly, now that I have found your e-mail address, you will indeed be hearing from me.

Mr. Waidson:

If you can send us an e-mail (which is the normal way to handle this), proving that you are who you say you are, then we would be happy to take down the photo, or give you credit. We did not pull this image from the site you have linked, it was taken from another, so I suggest in the future that you ‘watermark’ your images if you are really concerned about other people using them. Its common sense.

I am wondering why you imagine that you have the right to steal my photographic work and infringe my copyright, by using my picture at the top of this page, without my permission or even attempting to give me credit?

This usage does not constitute “fair use,” is in breach of UK and US law and I insist that you cease and desist immediately.
